Privacy notice: e-mailing Clacta
Who we are. FSFM GmbH (Clacta), Fischerinsel 6, 10179 Berlin, Germany. Contact for privacy questions or complaints: info@fsfmgmbh.com.
When this applies. When you write to an address at team.clacta.com, or reply to an e-mail we sent you because you asked for something (a report, a request, an account). If you are replying to an e-mail we sent you first, without your asking, our outreach notice applies instead: /privacy/outreach.
What we keep. Your e-mail address; your name, company and role as they appear in your e-mail or as you tell us; the e-mails you send us and our replies; and our notes on what you're looking for and what we agreed to do next.
Why, and on what legal basis. To answer you and do what you ask (Art. 6(1)(b) GDPR: steps taken at your request). To keep a record of the conversation and follow up on what you asked for (Art. 6(1)(f) GDPR: our legitimate interest in following up with businesses that have contacted us).
Your right to object. You can object at any time to our keeping this record and following up (Art. 21 GDPR). Reply "stop", or write to nora@team.clacta.com. We then stop and delete the record, except what the law requires us to keep.
Who writes our replies. Our replies are written and sent by Clacta's AI assistant, and it says so in its e-mails. To read your e-mails and write its replies, it passes them to a service provider in the USA, which processes it under its own terms (see "Who else processes it"). A person on our team sees the conversations that need one.
Who else processes it.
- Resend. Resend, Inc. (USA) sends and receives our e-mail on our behalf, as our processor; it relies on the EU-U.S. Data Privacy Framework and the European Commission's standard contractual clauses.
- Writing-assistance provider (USA). It processes what we pass to it under its own terms. The setting that would let it use that content to train its models is switched off on our account. It transfers data from the EU to the USA on the basis of an adequacy decision or the European Commission's standard contractual clauses; ask us for details at info@fsfmgmbh.com.
- Our servers (Hetzner, Germany) receive them, and our database (Supabase, EU) stores them.
How long. Once 12 months have passed since the last e-mail in the conversation, we delete it within the following month. If the conversation leads to an order, we keep the business letters for 6 years, as German commercial law requires (§257 HGB). E-mails to nora@team.clacta.com, our address for legal matters and for exercising your rights, are kept as long as we need them to show how we handled the matter.
Your rights. To have your data deleted, write "delete my data" to the address you wrote to, or to nora@team.clacta.com. Your other rights and the supervisory authority: see our main privacy policy.
