Privacy notice: messaging Clacta on WhatsApp

When this applies. When you send a WhatsApp message to our number +49 30 83212649, for example after scanning a QR code at a trade fair or clicking the WhatsApp link on our website.
What we receive and keep.
- your WhatsApp phone number, and the country it belongs to (read from the calling code);
- the short code in your first message, such as "P01" or "WEB". It tells us which of our promoters, or which link, brought you to us;
- when you wrote and when we replied, and which of our automatic replies we sent;
- the text of a message only when our system passes it to a person on our team: when you ask for a person, make a complaint, or send a reply our system can't handle on its own. We keep that text for 30 days.
- if you ask us to check a company: the company name and website from your request, and the code of the link or QR you came from (for example "CF1S01"). We keep them with your number so we can tell you when the report is ready, and they are deleted together with your number. The company name and website on their own, without your number, stay on our list of companies to research.
Apart from that, we don't keep the text of your messages: our system reads them to choose a reply and then discards them. WhatsApp also sends us your profile name with each message. We don't store it.
Why, and on what legal basis.
- To answer your messages and send you what you asked for (Art. 6(1)(b) GDPR: steps taken at your request).
- To count how many people each promoter brought to us, so we pay them correctly (Art. 6(1)(f) GDPR: our legitimate interest in paying the people who work for us correctly). Promoters receive only a count, never your number.
Automatic replies. Our replies are sent automatically and say so. Which reply you get depends on your answer and on your number's country code. This decides nothing else about you.
We don't message you on our own initiative. We only answer messages you send us. If we ever want to send you news or offers on WhatsApp, we'll ask you first in the chat, and only send them if you say yes.
Who else processes it.
- WhatsApp / Meta. Our number runs on Meta's WhatsApp Business Platform (Cloud API). Meta Platforms Ireland Limited processes the messages between you and us on our behalf, as our processor. Meta keeps message data for at most 30 days, to deliver it (for example, to retry a delivery). Meta may transfer data to Meta Platforms, Inc. in the USA and states that it relies on appropriate GDPR-compliant transfer mechanisms for this. Meta may also use the data as its own controller to keep the service safe and secure. Your own use of WhatsApp is governed by WhatsApp's terms and privacy policy: https://www.whatsapp.com/legal/privacy-policy-eea.
- Our hosting: our database (Supabase, EU) and our server (Hetzner, Germany). We don't sell your data or pass it to anyone else.
- If you ask us in the chat to contact you another way (for example by email), we use the details you give us for that.
How long. Your number and our record of the chat are deleted 90 days after your last message. Message texts passed to a person are deleted after 30 days. Our payout records for promoters contain only counts, no phone numbers.
How to have your data deleted. Send "delete my data" to us on WhatsApp. Our system deletes your number and our record of the chat straight away and confirms it in its reply. Or write to info@fsfmgmbh.com with your WhatsApp number, and we'll delete it and confirm by email. Messages that are still on your own phone, or with WhatsApp, are deleted in WhatsApp (see WhatsApp's privacy policy above).
Your rights. You can ask for access, correction, deletion or restriction, and you can object to processing based on our legitimate interest. You can also complain to a supervisory authority. Details are in our main privacy policy.
